The US demanded airlines to provide personal passenger data for all inbound flights. This was first raised after 9/11 happened.
And in 2004, the United States and the European Union signed an agreement which allows US Customs and Border Protection (CBP) to get passenger data from European airlines flying to and from the US. New talks between the US and the EU, however, have broken down today. AND (!) the European Court of Justice has ruled the previous agreement signed as illegal, saying that there is NO AGREEMENT.
This means that "airlines refusing to provide passenger lists to the US may lose landing rights in the country, but those that do risk facing legal action under EU member states' data protection legislation".
Catch22.
